1. Age Restriction (18+)

Brand Battles is intended solely for users who are 18 years of age or older. By creating an account or using the App, you represent and warrant that you meet this age requirement. If we become aware that a user is under 18, we reserve the right to immediately terminate the account and delete associated data.

2. Information We Collect

We collect the following categories of information to operate the “Play. Win. Earn.” experience:

• Personal Information: Name/username, email address, and account identifiers.
• User Preferences: Age range, gender, and interests provided voluntarily to personalize gameplay.
• Gameplay & Reward Data: Progress in games, quiz responses, and token distribution history.
• User-Generated Content (UGC): Photos and videos uploaded by users for review missions and competition boosts.
• Shipping Information: Physical address, collected only when a user claims a physical reward.
• Affiliate Tracking & Cookies: We use third-party affiliate networks (e.g., Admitad, Rakuten) to provide coupons. These partners may use cookies to track and validate your rewards.
• Device Information: Device type, OS version, and approximate location (city/country) for security and fraud prevention.

3. How We Use Your Information

• To operate gameplay mechanics, quizzes, and token systems.
• To provide hyper-personalized product recommendations based on your choices.
• To facilitate the distribution of digital coupons and physical rewards.
• To maintain platform security and prevent fraudulent activity.

4. Data Sharing and User Content Rights

We share information only when necessary for the platform to function:

• Brand Partners (Fulfillment): If you win a physical product (e.g., Brand Drops, Weekly Prizes), we share your shipping information with that specific brand partner for delivery purposes only.
• UGC Rights: By submitting a photo or video review to earn tokens, you grant Brand Battles and the participating Brand a non-exclusive, royalty-free, perpetual license to use this content for marketing and promotional purposes.
• Affiliate Networks: We share anonymized transaction IDs with partners to verify rewards. No PII (Personally Identifiable Information) is shared for tracking purposes.
• Aggregated Insights: Brands receive only anonymized, non-identifiable reports (e.g., “70% of users prefer this product”). They never receive individual user profiles.

5. Rewards, Delivery, and Geographic Limits (USA Only)

• Geographic Limit: Brand Battles currently operates only within the United States. Physical rewards are delivered only within the USA.
• Fulfillment by Brands: Participating brands are solely responsible for fulfillment. Brand Battles is not liable for shipping delays, damages, or failure to fulfill.
• Tracking: Tracking numbers provided by brands will be displayed in the App.
• Third-Party Links: Discounts via affiliate links are subject to the terms of external sites. We are not responsible for expired offers on partner platforms.
• Verification: Rewards may be withheld if a transaction is cancelled, returned, or flagged as fraudulent.
• Social Media Disclosure: Users must include mandatory disclosures (e.g., #Ad or #Sponsored) as per FTC guidelines.

6. Your Rights and Account Deletion

You have the right to access, update, or request deletion of your account at any time. To exercise these rights:

7. Data Security

We use encrypted transmission (HTTPS) and technical safeguards to protect your information. While no system is 100% secure, we take all appropriate steps to prevent unauthorized access.
