Welcome to Brand Battles. By accessing or using our mobile application, website, or related services (the “App“), you agree to be bound by these Terms & Conditions. If you do not agree, you must discontinue use immediately.

1. Acceptance of Terms

By creating an account or using the App, you agree to be legally bound by these Terms and our Privacy Policy.

2. Eligibility (18+ and USA Only)

• You must be at least 18 years old.
• You must be a legal resident of the United States.
• Participation from outside the United States is strictly prohibited.
• We may use Geo-IP and other verification technologies to verify eligibility.
• We reserve the right to verify your age, residency, and identity at any time.

3. Account Registration & Security

• You agree to provide accurate and complete information.
• You are responsible for maintaining the security of your account.
• We may limit accounts per device, IP address, or user.
• We may suspend, restrict, or terminate accounts suspected of abuse.

4. Tokens & Virtual Credits

• Tokens are virtual credits used within Brand Battles.
• Tokens have no monetary value.
• Tokens cannot be redeemed for cash.
• Tokens are not property or financial instruments.
• Brand Battles reserves the right to modify, suspend, adjust, or expire Tokens in accordance with these Terms.

5. Rewards, Eligibility & Verification

• Reward eligibility is subject to internal integrity review.
• Newly created accounts may be subject to a verification or waiting period before becoming eligible for certain rewards, promotions, or prize distributions.
• Brand Battles may determine eligibility at its sole discretion.
• Rewards may be withheld for suspected fraud, abuse, automation, multi-accounting, or violations of these Terms.
• Eligibility decisions may rely on automated systems and behavioral analysis.
• Brand Battles is not required to disclose fraud detection methods or eligibility criteria.
• All eligibility decisions are final.

6. Physical Prizes & Taxes

• Physical prizes are fulfilled exclusively by participating Brand Partners.
• Brand Battles is not the seller, merchant of record, or fulfillment provider for any physical reward.
• Brand Battles is not responsible for shipping delays, damaged goods, lost packages, fulfillment failures, or customer service issues.
• Prize winners are responsible for applicable taxes.
• If required by law, Brand Battles may request IRS Form W-9 and issue Form 1099-MISC.

7. User Conduct & Anti-Abuse

• No bots, scripts, emulators, or automation tools.
• No gameplay manipulation.
• No multi-account exploitation.
• No VPN or proxy use to bypass geographic restrictions.
• No fraudulent content uploads.
• Violations may result in suspension, termination, or loss of reward eligibility.

8. Promotions & Updates

• Brand Battles may modify or cancel promotions at any time.
• Reward amounts, leaderboards, and eligibility rules may change.
• All promotional decisions are final.

9. Coupons

• Coupons are provided by participating Brand Partners.
• Coupon availability, validity, redemption, and restrictions are determined solely by the participating Brand Partner.
• Coupon terms may vary by offer.
• Expired coupons cannot be restored.
• Brand Battles is not responsible for coupon redemption issues occurring on a Brand Partner’s website.

10. Redeem & Third-Party Services

Selecting “Redeem Now” redirects you to the participating Brand Partner’s website.

Purchases, payments, shipping, fulfillment, customer service, and any personal information you provide are handled directly by the participating Brand Partner and are governed by that Brand Partner’s own Terms of Service and Privacy Policy.

Brand Battles does not receive or control any personal information collected during checkout or redemption on a participating Brand Partner’s website.

11. No Guarantee of Availability

Brand Battles does not guarantee uninterrupted service, leaderboard accuracy, reward availability, coupon availability, or error-free operation.

12. Limitation of Liability

To the fullest extent permitted by law, Brand Battles shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of Tokens, reward disputes, coupon disputes, technical interruptions, or eligibility determinations.

13. Governing Law & Arbitration

These Terms are governed by the laws of the State of Delaware.

All disputes shall be resolved through binding arbitration in Delaware.

You waive the right to participate in any class action lawsuit or jury trial.
